On January 9, 2009 the United States (U.S.) Sixth Circuit Court of Appeals held in National Cotton Council, et al., v. EPA that Clean Water Act permits are required for all biological pesticides and chemical pesticides applications that leave a residue in water when such applications are made into or over, including near waters of the U.S. In response to this decision, EPA has developed a draft NPDES pesticides general permit and required NPDES- authorized states to develop their NPDES permits.  In Texas, this program will be administered by the Texas Commission on Environmental Quality (TCEQ).
