Application Process for Section 3 Registration of Pesticides

Step 1: Submit completed PR-200 Application for Section 3 Registration.

The PR-200 is the application for a Section 3 registration of a Pesticides. The form can be downloaded by clicking here. Review the instructions for assistance in completing the PR-200 form, instructions can be downloaded by clicking here. Information necessary to register a section 3 pesticide in Texas can be obtained from Title 4 Texas Administrative Code (TAC) Chapter 7, (§7.10 and §7.11) or by clicking here .

Step 2: Submit necessary information and documents.
Please review the checklist below or Page 4 of the PR-200 to ensure you have submitted all required information. Registrants must submit legible paper copies of all required documentation.  Registrants may electronically submit all required documentation through ALSTAR, except the PR-200 form and fees which must be mailed.
USB drives and CDs are not accepted. 
Do not include the product Confidential Statement of Formula statement in any correspondence to the department unless requested to do so.
 
Step 3: Submit Product Proration Fee.
Submit the appropriate registration proration fee per product. The Product Proration fee is based on the first letter of the Doing Business As (D.B.A.) the company name from the product label, or, if no D.B.A. name is shown, the first letter of the Full legal business name as shown on the PR-200. See the Product Proration Chart on Page 5 of the PR-200 for more instructions on how to determine amount of fees to submit.
 
PR-200 applications with fees should be mailed to P.O. Box 12401 Austin, TX 78711-2401.  Mailing applications with fees to the TDA physical address, 1700 North Congress, RM. 1125E Austin, TX 78701, will result in an extended processing time.
The Texas Department of Agriculture does not provide expediting services for any type of Pesticide Product Registration. Registration applications are processed in the order they are received. 

Registrants submitting incomplete applications will be notified in a letter explaining the discrepancies. Corrective action must be completed within 1 year or the review process will be canceled and the registration fee(s) forfeited.
Certificates of Registration are mailed to the person to contact for license related matters mailing address provided in Section C of the PR-200; until updated using the PR-201 Pesticide Registrant Change of Business Information form.


Check List

Please use this checklist to ensure you are sending all of the necessary information and documents for each product to be registered. 

1. Product Label - The current product label that is affixed to the container must be submitted. The product label should include the EPA Registration Number and Net Contents amount in U.S. measurements.  Font size must be large enough to read easily, (minimum of 6 pt.). 
2. EPA Supplemental Registration Distribution Form 8570-5, if applicable - Submit EPA date stamped Notice of Supplemental Distribution of a Registered Pesticide Product Form 8570-5 for each supplemental distribution of a registered product.
3. Material Safety Data Sheet (MSDS)/Safety Data Sheet (SDS) - MSDS/SDS must have complete product name and current name and address of registrant        
4. Current EPA Stamped Accepted Label (SAL)  – Each new product registered must include a copy of the EPA SAL including letter containing EPA comments page (if applicable), and any other EPA correspondence approving changes to the SAL. 
5. Supporting Documentation – Each new product registered must include any Notifications, Amendments Transfer of registration papers, container Sizes, etc. not readily available on the EPA Pesticide Product & Label System website, 

6. EPA Application for Pesticide Registration/Amendment Form 8570-1, if applicable – Each new product registered must include the EPA 8570-1, for each alternate brand name registration or a letter from EPA stating it is an approved alternate brand name. for each alternate brand name (if applicable).


Amended/Revised Pesticide Product Label
Per Title 4 TAC Chapter 7, §7.10(i) After a product is registered with the department, registrants shall provide the department the most current pesticide product label any time the product label is amended. 
 
How to Submit Amended/Revised Product Label
 
Companies that participate in ALSTAR:
Submit the required documents into ALSTAR for review and acceptance.
 
Companies that do Not participate in ALSTAR:
Email Product.Registration@TexasAgriculture.gov with “Amended/Revised Registered Label” in the subject line, including the TDA Product Name, TDA Account Number, EPA Registration Number and registrant’s name. Indicate in your email what was revised on the label and the date EPA approved the revisions if applicable.  Submit one revised label per email or; 

Submit the amended/revised label by mail to:  Texas Department of Agriculture P.O. Box 12847 Austin, TX 78711-2847.
