Pesticide Product Registration

As the lead agency in Texas for regulating pesticides, TDA is responsible for registering pesticides before they are distributed and/or sold in Texas. The Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) as amended, provides the federal requirements for pesticide registration. The U.S. Environmental Protection Agency (EPA) provides the federal regulation requirements for pesticide registration under Title 40 Code of Federal Regulations (40 CFR) Protection of Environment.

The Pesticide Product Registration Program processes EPA registered Section 3 pesticide applications for state registration; reviews and authorizes Section 24(c) Special Local Need (SLN) applications and Section 18 Emergency Exemptions for EPA submission and acceptance; and approves 2(ee) recommendations and Section 5 Experimental Use Permits (EUP).

The Pesticide Product Registration Program issues notarized Certificates of Free Sale, Manufacturer, and Origin upon request.

The list also designates federally restricted, regulated herbicides and or state-limited use pesticide classifications. Pesticide Registration Exemptions

Registration is not required in Texas for a pesticide that is exempt from registration with EPA under federal law.

Pesticide products exempt from Texas registration include: treated articles or substances; pheromones and pheromone traps; preservatives for biological specimens; foods; natural cedar; minimum risk pesticides (25b); devices; and co-packs. In addition, products that qualify under 40 CFR Sections 152.6, 152.8, 152.10, 152.20, and 152.25 do not require a registration.

FIFRA 25(b) Exemptions

Federal regulations contain specific requirements to be eligible for exemption. See EPA’s Minimum Risk Pesticides Exempted from FIFRA Registration site for complete information. Registration is not required in Texas however the following Label Requirements in TAC Rule §7.11(2) are required if the pesticide is not subject to registration under FIFRA.

Registration is not required for the transportation of a pesticide from one plant or warehouse to another plant or warehouse operated by the same person if the pesticide is used solely at the second plant or warehouse as a constituent of a pesticide that is registered.

Registration is not required for a pesticide that is not for use in this state and is being manufactured, transported, or distributed for use only outside of this state.

Registration is not required for a chemical compound being used only to develop plot data as to the possible pesticidal action of the chemical. Plot data may only be developed on an area(s) totaling 10 or less acres.
